Welcome to Fireflower Cottage / Studio Cerissa (the "Site," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, TikTok Shop storefront, and any products or services offered through them (collectively, the "Services"). By accessing or using the Services, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

The Services are intended for general audiences. We do not restrict purchases by age, but we recommend parental guidance for minors, as some products reference spiritual, metaphysical, or ritual practices intended for adult use and understanding. If you are under the age of 18, please use the Services only with the involvement of a parent or guardian.

2. Nature of Our Products

Our products — including spell jars, intention sprays, ritual ropes, dried herbs, smudging wands, and related items — are handmade, curated, or sourced goods intended for symbolic, decorative, spiritual, and personal ritual use. They are sold for their intended cultural, spiritual, and aesthetic purpose. Our products are not intended to diagnose, treat, cure, or prevent any medical or psychological condition, and no such claims are made or implied. Any description of a product's properties is symbolic and traditional in nature, not a guarantee of effect. If you have a medical or psychological concern, please consult a licensed professional.

3. Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your login information and for all activities under your account. Notify us immediately of any unauthorized use.

4. Orders, Pricing & Payment

  • All prices are listed in U.S. dollars and are subject to change without notice.
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized transactions, or errors in pricing or product information.
  • In the event of a pricing or listing error, we will notify you and offer the option to proceed at the correct price or cancel your order for a full refund.
  • Payment is processed securely through Shopify Payments or other supported payment processors; we do not store your full payment card details.

5. Handmade & Small-Batch Goods

Because many items are handmade in small batches, slight variations in color, texture, scent, and appearance are normal and expected, and do not constitute defects. Product photos are representative but may differ slightly from the item you receive.

6. Print-on-Demand (POD) & Digital Products

  • POD items are produced individually per order through a third-party production partner upon purchase.
  • Digital products are delivered electronically and are subject to the terms in our Return & Refund Policy.

7. Wholesale

Wholesale purchases are subject to separate wholesale agreements, which take precedence over these Terms where applicable.

8. Shipping & Risk of Loss

Shipping timelines are estimates and not guaranteed. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. We are not responsible for delays, loss, or damage caused by the carrier once shipped, though we will assist in filing claims where possible.

9. Returns & Refunds

Returns and refunds are governed by our separate Return & Refund Policy, available on our Site.

10. Intellectual Property

All content on the Services — including text, graphics, logos, product designs, photography, and branding for Fireflower Cottage and Studio Cerissa — is our property or used with permission, and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written consent.

11. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to interfere with, hack, or disrupt the Services
  • Submit false, misleading, or fraudulent information
  • Infringe upon our intellectual property or that of others

12. Reviews & User Content

If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services. You are solely responsible for content you submit and confirm it does not violate any third party's rights.

14. Limitation of Liability

To the fullest extent permitted by law, Fireflower Cottage / Studio Cerissa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless Fireflower Cottage / Studio Cerissa, its owner, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.

16. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law principles.

17. Dispute Resolution & Binding Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by a recognized arbitration organization (such as the American Arbitration Association) in accordance with its applicable rules, rather than in court. Arbitration will take place in Maryland unless otherwise agreed. You and Fireflower Cottage / Studio Cerissa each waive the right to a jury trial and the right to participate in a class action.This section does not prevent either party from bringing an individual claim in small claims court where permitted.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We will update the "Last updated" date accordingly.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
